Terms of Use
Take a moment to browse through this page. We think it is at least as important as our product pages, maybe more so. Our lawyers have requested that we include this page to establish some ground rules. It is written in plain English, with few legal terms, so you will have no trouble understanding what we are saying. Take time now to familiarize yourself with our legal page. When you visit this site you are obligated to abide by the terms and conditions listed below.
We have established this web site for your convenience and that of our customers. You are permitted to use the information contained on its pages for your information and education. You are free to browse as much and as often as you like–even show it to your friends and business acquaintances. You are also permitted to download our text, pictures, property charts, audio and video files for your own personal use. But don’t disturb, modify, repost, distribute, or retransmit anything, especially the trademark notices, registration notices, copyright information or warranty information unless specifically given permission by us to do so in writing.
The following is a list of our ground rules for visiting our site:
Assume everything on our site is copyrighted and you will stay out of trouble.
We don’t promise that our information is accurate.
We are not responsible for errors or omissions. Use the information at your own risk.
We assume no liability for the information or data contained in any of these web pages. Use the information at your own risk.
We and anybody else who helped us create, produce, or deliver the site are not liable for any damages you suffer when you use it. In particular, the lawyers want you to know that our disclaimer includes “direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the site. Without limiting the foregoing, everything on the site is provided to you ‘AS IS’ WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE OPERATIONAL EXCELLENCE SOCIETY LLC FURTHER DISCLAIMS ANY LIABILITY IN CONNECTION WITH THE SITE OR THE INFORMATION PROVIDED HEREIN. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding the exclusion of implied warranties.” We put all of that in quotes because we couldn’t figure out any other way to say it that the lawyers would accept. But here’s the bottom line – we’re not responsible if you’re browsing around and the site damages you or your computer or infects it with any nasty viruses. We sure hope that doesn’t happen, but if it does, don’t call us.
Also, this website is published and hosted in the United States of America and is owned by the Operational Excellence Society LLC, a Wyoming Limited Liability Company. As such, this Agreement shall be governed by the laws of the State of Wyoming, United States of America, without reference to choice of law rules otherwise applicable. The Parties consent to and agree that the United States Federal Court for the District of Wyoming, and the State Courts of Wyoming have sole and exclusive jurisdiction to resolve any interpretation, construction, breach, dispute or other controversy arising out of, connected with or associated with this Agreement. The Parties hereby expressly waive any objection to such exclusive jurisdiction.
Any reference to entities, partners or activities outside of the United States is purely coincidental and for information purposes only. None of the entities or partners which may exist outside the United States of America have any ownership interests in this website or in any of the content contained herein.
If you don’t want the world to know something, don’t post it on the site in any bulletin board or anyplace else because anything you disclose to us is ours. We reserve the right to do anything we want with the stuff you post. We can reproduce it, disclose it, transmit it, publish it, broadcast it, and post it someplace else. Not only that, we can even use any ideas, concepts, know-how, or techniques you post any way we want to, including developing, manufacturing, and marketing products, or other stuff using the information you post.
Pictures of people or places shown on the site are either our property or someone else’s property we’re using with their permission. No matter, it’s definitely not your property. Be careful how you use it, because unauthorized use may violate all sorts of nasty laws. Be smart, keep the stuff you download to yourself.
There are also a lot of trademarks, logos, and service marks on the site that either we own or we’re using with someone else’s permission. You have no rights or any kind of license to use them. You may not distribute, retransmit, repost, reuse, modify or otherwise edit or change the trademarks, logos, and service marks on our site in any way.
You’ll probably notice we’ve linked our site to a lot of others. While that’s cool, it doesn’t mean we’ve looked at all these sites, much less check them out periodically to see what’s going on. Don’t blame us if some site you link to is bad or has stuff on it that offends you. Go ahead and link, but remember you’re doing it at your own risk. We are not responsible for nor do we endorse the contents or use of these Web sites.
That brings us to what you do on our site. While we occasionally listen in on chat groups, or look at all the postings in our discussion groups or on bulletin boards, we take no responsibility and assume no liability for the content of those locations or for any mistakes, defamation, libel, slander, omissions, falsehoods, obscenity, pornography, or profanity you might encounter when you visit such places on our site. And don’t be stupid by posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, nasty, mean or profane material or any material that law enforcement types may consider a criminal offense, get someone in court on a civil lawsuit, or for that matter, violate any law – anywhere, anytime. While we certainly respect your privacy, we have no choice but to fully cooperate with any law enforcement authorities or court that asks us who might have posted nasty stuff on our site.
We’re reserve the right to change this page or anything else on the site any time. If we do change the page, then you’re bound by those changes, too, whenever you visit our site.
